Facts

The Appellants/Applicants herein filed an application seeking for an order granting leave to adduce further or additional evidence which was not tendered at the two lower courts. Learned counsel to the Applicants in his brief admitted that when he was engaged as counsel by the applicants, he realized the need to raise on appeal the issue of jurisdiction of the trial court as a fresh issue.
